Pro liability excluding (building insurance)
Your professional activity can potentially represent risks and damages for a third party and thus incur your civil liability: this leading to an obligation to compensate for the damage suffered.
It is therefore necessary to be familiar with the legal framework of professional civil liability or PRO liability which is commonly included in a professional comprehensive insurance contract.
Professional civil liability: definition, texts and professional application
The French civil code clearly defines civil liability in two articles:
- Art. 1382 of the Civil Code: “Any act whatsoever of man, which causes damage to another, obliges the person through whose fault it happened to repair it. »
- Art.1384 of the Civil Code: “We are responsible not only for the damage that we cause by our own actions, but also for that which is caused by the actions of people for whom we must answer, or things that we have under his care. »
Civil liability covers several types of damage:
- property damage,
- injury,
- financial losses etc.
They can be caused by:
- neglect
- recklessness
- employees
- one's own deed (act)
- machines or buildings
Professional civil liability applies when a professional activity causes damage or harm to a customer, a supplier or a third party.
The latter can thus claim compensation for the damage suffered, which is most often formalized by the payment of financial compensation.
To do this, it must be clearly established that the civil liability of the professional is incurred based on three main types of evidence:
- a damaging event: the damage is committed by the author of the fault or by the fact of the thing in his care (buildings, machines, etc.),
- damage: without sudden damage, RC PRO cannot be initiated,
- a causal link: between the damage and the harmful event.
